When you have a serious issue with your mortgage servicer, a phone call often doesn't cut it. Notes get lost. Representatives change their story. Nothing gets resolved. The most effective legal tool available to mortgage borrowers is the Qualified Written Request (QWR).

What Is a QWR?

A Qualified Written Request is a formal written inquiry protected under Section 6 of the Real Estate Settlement Procedures Act (RESPA). Once your servicer receives a valid QWR, they are legally required to:

  • Acknowledge receipt within 5 business days
  • Respond substantively within 30 business days
  • Not report negative information to credit bureaus for 60 days regarding the disputed matter
  • Provide specific information or explain why they can't

When to Use a QWR

QWRs are appropriate for any dispute involving:

  • Payment posting errors or misapplied payments
  • Escrow account discrepancies (taxes, insurance)
  • Late fees you believe are incorrect
  • Missing or unrecorded loan modifications
  • Requests for loan documentation or payment history
  • Any billing or servicing dispute

QWR Template Structure

Every QWR should include these elements to be legally valid:

1. Header — Identify Yourself and the Loan

Include your full name, current address, phone, email, loan number, and property address at the top. Without loan identifiers, the servicer may reject your request as invalid.

2. Statement of Purpose

State clearly: "This is a Qualified Written Request under Section 6 of the Real Estate Settlement Procedures Act (12 U.S.C. § 2605)." This phrase triggers the legal protections.

3. Specific Issue Description

Describe the problem in plain, factual language. Include specific dates, dollar amounts, and reference numbers wherever possible. Avoid emotional language — stick to facts.

4. Documentation Request

List the specific documents or information you need. Common requests:

  • Complete loan payment history
  • All escrow account statements for the past 2 years
  • Any correspondence related to the disputed matter
  • Copies of your loan modification agreements, if applicable

5. Requested Action

State clearly what you want the servicer to do. For example: "Please credit my account $X on date Y" or "Please correct the escrow analysis and issue a refund of $Z."

6. Signature and Date

Sign and date the letter. Keep a copy.

How to Send It

Send your QWR via USPS Certified Mail with Return Receipt Requested. This creates legal proof of delivery. Save the certified mail receipt and the returned green card.

What Happens Next

Within 5 business days you should receive an acknowledgment. Within 30 business days, you should receive a substantive response — either fixing the issue, requesting more information, or explaining why they believe your request is invalid.
